Box 368 Houston, Texas 77001-0368 OR2012-18511 Dear Ms. Folsom: You ask whether certain information is subject to required public disclosure under the Public Information Act (the "Act"), chapter 552 of the Government Code. Your request was assigned ID# 475533 (GC No. 20105). The Houston Emergency Center (the "center") received a request for information pertaining to a specified 9-1-1 call. You claim the requested information is excepted from disclosure under section 552.108 of the Government Code. We have considered your claim. We have also considered comments submitted by the requestor. See Gov't Code § 552.304 (providing that interested party may submit comments stating why information should or should not be released). You inform us the requested information was previously the subject of a request for information, in response to which this office issued Open Records Letter No. 2012-17262 (2012). In the previous ruling, we concluded the center may withhold the information at issue under section 552.108(a)(1) of the Government Code on behalf of the Houston Police Department. As you do not indicate there has been any change in the law, facts, and circumstances on which the previous ruling is based, we conclude the center may continue to rely on Open Records Letter No. 2012-17262 and withhold the requested information on the basis of the previous ruling. See Open Records Decision No. 673 at 6-7 (2001) (listing elements of first type of previous determination under Gov't Code § 552.301(a)). This letter ruling is limited to the particular information at issue in this request and limited to the facts as presented to us; therefore, this ruling must not be relied upon as a previous determination regarding any other information or any other circumstances.
