Box 368 Houston, Texas 77001-0368 OR2012-11655 Dear Ms. Evans: You ask whether certain information is subject to required public disclosure under the Public Information Act (the "Act"), chapter 552 of the Government Code. Your request was assigned ID# 460352 (GC# 19699). The Houston Police Department (the "department") received a request for all documents relating to DNA testing carried out in regards to incident number 96952690, including but not limited to descriptions of the samples tested, the samples' origins, the samples' current location and status, and test results. You claim the submitted information is excepted from disclosure under sections 552.101 and 552.108 of the Government Code. We have considered the exception you claim and reviewed the submitted representative sample of information. (1) Initially, we note the requestor seeks only documents relating to DNA testing, including descriptions of the samples tested, the samples' origins, the samples' current location and status, and test results. You have submitted documents that contain information beyond these specific pieces of information. Thus, the portions of the submitted documents that do not consist of the information requested are not responsive to the present request. This ruling does not address the public availability of any information that is not responsive to the request and the department is not required to release that information in response to the request. Section 552.108(a)(2) of the Government Code excepts from disclosure information concerning an investigation that did not result in conviction or deferred adjudication. See Gov't Code § 552.108(a)(2). A governmental body claiming section 552.108(a)(2) must demonstrate the requested information relates to a criminal investigation that has concluded in a final result other than a conviction or deferred adjudication. See id. § 552.301(e)(1)(A) (governmental body must provide comments explaining why exceptions raised should apply to information requested). You state the submitted information is part of a concluded investigation that did not result in conviction or deferred adjudication and in which the statute of limitations has passed. Based on these representations and our review, we agree the department may withhold the responsive information under section 552.108(a)(2) of the Government Code. (2) This letter ruling is limited to the particular information at issue in this request and limited to the facts as presented to us; therefore, this ruling must not be relied upon as a previous determination regarding any other information or any other circumstances. This ruling triggers important deadlines regarding the rights and responsibilities of the governmental body and of the requestor.
