Dear Ms. Bowen:

This is in reference to your letter of January 24, 2012, regarding two requests the Bexar County Sheriff's Office and the Bexar County Constable's Office (collectively, the "county") received from the same requestor for (1) the amount of money raised by forfeitures during a specified time period and (2) an inventory list of all forfeitures during a specified time period. Your letter was assigned ID# 449362.

Generally, the Public Information Act (the "Act"), chapter 552 of the Government Code, authorizes the Office of the Attorney General to render decisions and opinions in two situations. The first occurs when a governmental body receives a written request for information from an individual or entity acting as a member of the public and requests a ruling from this office because the governmental body wishes to withhold responsive information in accordance with one of the Act's exceptions to disclosure. See Gov't Code §§ 552.301, .306. The second situation occurs when this office issues "materials, including detailed and comprehensive written decisions and opinions, that relate to or are based on [the Act]" in order to "maintain uniformity in the application, operation, and interpretation of [the Act.]" Id. § 552.011.

You state the county has released the submitted information with the exception of vehicle identification numbers ("VIN") in Exhibit 3 and the name of an officer in Exhibit 4. However, we note Exhibit 3 does not contain any VINs and Exhibit 4 does not contain the name of an officer. Therefore, we understand that the county does not seek to withhold any responsive information. We therefore will consider this matter closed. If you have any questions with regard to this letter, please refer to ID# 449362.
