Dear Ms. Garcia:

You ask whether certain information is subject to required public disclosure under the Public Information Act (the "Act"), chapter 552 of the Government Code. Your request was assigned ID# 444499 (UNT PIR No. 000837).

The University of North Texas (the "university") received a request for information related to an incident that was investigated by the university's police department. You inform us some of the requested information has been released. You claim the submitted information is excepted from disclosure under section 552.130 of the Government Code. We have considered the exception you claim and reviewed the information you submitted. (1)

Section 552.130 of the Government Code excepts from disclosure information related to a motor vehicle operator's or driver's license or permit or a motor vehicle title or registration issued by an agency of this state or another state or country. See Gov't Code § 552.130(a)(1)-(2). You state the submitted video recording contains motor vehicle record information that falls within the scope of section 552.130. You inform us the university is not technologically capable of redacting that information from the recording. Based on your representations and our review of the information at issue, we conclude the university must withhold the submitted video recording in its entirety under section 552.130 of the Government Code.

This letter ruling is limited to the particular information at issue in this request and limited to the facts as presented to us; therefore, this ruling must not be relied upon as a previous determination regarding any other information or any other circumstances.
