Re: Request for the public portion of the police report related to the arrest of a named Sugar Land Police Officer, including the mug shot of the suspect and any dashcam video related to the arrest; COS11-050.

Dear Mr. Pertile:

The Office of the Attorney General has received your request for a ruling and assigned your request ID# 441818.

After reviewing your arguments and the submitted information, we have determined your request does not present a novel or complex issue. Thus, we are addressing your claims in a memorandum opinion. You have provided the requestor with the mug shot and state you submitted the offense report to this office as Exhibit 3. However, you in fact have not submitted the offense report to this office. Thus, you must release the report. See Gov't Code §§ 552.301, .302. Finally, you claim the video may be withheld from the requestor pursuant to section 552.108(a)(1) of the Government Code. We have considered your arguments and the submitted information and have determined that in accordance with section 552.108(a)(1) you may withhold the video.
