August 17, 2011 Mr. John Ohnemiller First Assistant City Attorney City of Midland PO Box 1152 Midland, Texas 79702-1152 OR2011-11913 Dear Mr. Ohnemiller: You ask whether certain information is subject to required public disclosure under the Public Information Act (the "Act"), chapter 552 of the Government Code. Your request was assigned ID# 427439. The City of Midland (the "city") received a request for a letter confirming certain details of a dog bite incident and documentation regarding that animal's vaccination record. You state you have released some information to the requestor. You claim a portion of the submitted information is excepted from disclosure under section 552.101 of the Government Code. We have considered the claimed exception and reviewed the submitted information. We first note you have not submitted any information responsive to the first part of the request, which seeks confirmation of certain details concerning the incident at issue. To the extent information responsive to that part of the request existed on the date the city received the request, we assume you have released it. See Open Records Decision No. 664 (2000) (if governmental body concludes that no exceptions apply to requested information, it must release information as soon as possible). If you have not released any such records, you must do so at this time. See Gov't Code §§ 552.301(a), .302. Section 552.101 of the Government Code excepts from disclosure "information considered to be confidential by law, either constitutional, statutory, or by judicial decision." Id. § 552.101. This section encompasses information protected by other statutes, such as section 826.0211 of the Health and Safety Code. This section provides in pertinent part that "[i]nformation contained in a rabies vaccination certificate or in any record compiled from the information contained in one or more certificates that identifies or tends to identify an owner or an address, telephone number, or other personally identifying information of an owner of a vaccinated animal is confidential and not subject to disclosure under [the Act]." Health & Safety Code § 826.0211(a). The only exception to this confidentiality is that the information may be disclosed "to a governmental entity for purposes related to the protectionof public health and safety." Id. § 826.0211(b). The submitted information consists of a rabies vaccination certificate. We find the owner's name and address you have marked are confidential under section 826.0211(a) of the Health and Safety Code and must be withheld under section 552.101 of the Government Code. The remaining information must be released to the requestor. This letter ruling is limited to the particular information at issue in this request and limited to the facts as presented to us; therefore, this ruling must not be relied upon as a previous determination regarding any other information or any other circumstances. This ruling triggers important deadlines regarding the rights and responsibilities of the governmental body and of the requestor.
