Box 368 Houston, Texas 77001-0368 OR2011-04167 Dear Ms. Eales: You ask whether certain information is subject to required public disclosure under the Public Information Act (the "Act"), chapter 552 of the Government Code. Your request was assigned ID# 412397 (GC No. 18118). The City of Houston (the "city") received a request for the "Uniformed Officer's Daily Reports" executed by two named police officers for a specified period of time and a copy of the request and approval for specified outside employment pertaining to a third named police officer. You claim that the requested information is excepted from disclosure under section 552.108 of the Government Code. We have considered the exception you claim and reviewed the submitted information. Initially, we note that you have not submitted the requested "Uniformed Officer's Daily Reports" for our review. Thus, to the this information existed when the present request was received, we assume it has been released. If such information has not been released, then it must be released at this time. See Gov't Code §§ 552.301(a), .302; see also Open Records Decision No. 664 (2000) (if governmental body concludes that no exceptions apply to requested information, it must release information as soon as possible). Section 552.108(b)(1) of the Government Code excepts from required public disclosure "[a]n internal record or notation of a law enforcement agency or prosecutor that is maintained for internal use in matters relating to law enforcement or prosecution . . . if . . . release of the internal record or notation would interfere with law enforcement or prosecution[.]" Gov't Code § 552.108(b)(1). A governmental body that claims an exception to disclosure under section 552.108 must reasonably explain how and why this section is applicable to the information that the governmental body seeks to withhold. See id. §552.301(e)(1)(A); see also Ex parte Pruitt, 551 S.W.2d 706 (Tex. 1977); Open Records Decision No. 434 at 2-3 (1986). This office has concluded that section 552.108(b)(1) protects certain kinds of information, the disclosure of which might compromise the security or operations of a law enforcement agency. See City of Fort Worth v. Cornyn, 86 S.W.3d 320, 327 (Tex. App.-- Austin 2002, no pet.) (section 552.108(b)(1) protects information that, if released, would permit private citizens to anticipate weaknesses in police department, avoid detection, jeopardize officer safety, and generally undermine police efforts to effectuate state laws). You seek to withhold the submitted "Extra Employment System" printout, which pertains to the employment of an off-duty police officer. You state that release of the submitted information would interfere with law enforcement by endangering the life or physical safety of law enforcement personnel because it would reveal the officer's location on specific days at specific times. Based upon your representations and our review, we agree that release of this information would interfere with law enforcement. See, e.g., Open Records Decision No. 456 (1987) (holding that forms indicating location of uniformed, off-duty police officers are excepted from disclosure under statutory predecessor to section 552.108 due to officer safety concerns). We therefore conclude that the city may withhold the submitted information under section 552.108(b)(1) of the Government Code. This letter ruling is limited to the particular information at issue in this request and limited to the facts as presented to us; therefore, this ruling must not be relied upon as a previous determination regarding any other information or any other circumstances.
