Bohn General Counsel Lake Travis Independent School District 3322 Ranch Road 620 South Austin, Texas 78738 OR2011-02033 Dear Ms. Bohn: You ask whether certain information is subject to required public disclosure under the Public Information Act (the "Act"), chapter 552 of the Government Code. Your request was assigned ID# 412603 (LTISD No. 010711-E1E/DL 4432). The Lake Travis Independent School District (the "district") received a request for all billing statements, invoices, and payments regarding mobile communications devices or related services paid during the month of December 2010. You state you have provided the requestor with some of the requested information. You claim portions of the submitted information are excepted from disclosure under section 552.136 of the Government Code. We have considered the exception you claim and reviewed the submitted information. Section 552.136 of the Government Code states "[n]otwithstanding any other provision of this chapter, a credit card, debit card, charge card, or access device number that is collected, assembled, or maintained by or for a governmental body is confidential." Gov't Code § 552.136. An access device number is one that may be used to (1) obtain money, goods, services, or another thing of value; or (2) initiate a transfer of funds other than a transfer originated solely by paper instrument. Id. We agree the district must withhold the bank routing numbers and account numbers you have marked under section 552.136 of the Government Code. (1) However, a check number does not constitute an access device number and may not be withheld based on section 552.136. Accordingly, the district may not withhold the check numbers you have marked under section 552.136; we have marked this information for release. This letter ruling is limited to the particular information at issue in this request and limited to the facts as presented to us; therefore, this ruling must not be relied upon as a previous determination regarding any other information or any other circumstances.
