Box 2570 Waco, Texas 76702-2570 OR2011-01573 Dear Ms. Villarreal: You ask whether certain information is subject to required public disclosure under the Public Information Act (the "Act"), chapter 552 of the Government Code. Your request was assigned ID# 407717 (City of Waco Reference # LG-10-1612). The City of Waco (the "city") received a request for information pertaining to a specified automobile accident. You indicate you are releasing some information to the requestor. You claim portions of the submitted information are excepted from disclosure under sections 552.101, 552.130, and 552.136 of the Government Code. We have considered the exceptions you claim and reviewed the submitted information. Section 552.101 of Government Code excepts from disclosure "information considered to be confidential by law, either constitutional, statutory, or by judicial decision." Gov't Code § 552.101. This exception encompasses information made confidential by other statutes. Chapter 772 of the Health and Safety Code authorizes the development of local emergency communication districts. Sections 772.118, 772.218, and 772.318 of the Health and Safety Code are applicable to emergency 9-1-1 districts established in accordance with chapter 772. See Open Records Decision No. 649 (1996). These sections make the originating telephone numbers and addresses of 9-1-1 callers furnished by a 9-1-1 service supplier confidential. Id. at 2. Section 772.318 applies to an emergency communication district for a county with a population of more than 20,000. You state the city is part of an emergency communication district established under section 772.318. You have marked the telephone number and address of a 9-1-1 caller that the city seeks to withhold under section 772.318. Provided that the information you have marked consists of the originating telephone number and address of a 9-1-1 caller furnished by a 9-1-1 service supplier, we agree that the city must withhold the marked telephone number and address under section 552.101 of the Government Code in conjunction with section 772.318 of the Health and Safety Code. However, to the extent the marked information is not the originating telephone number and address of a 9-1-1 caller furnished by a 9-1-1 service supplier, section 772.318 is not applicable to this information, and it must be released to the requestor. Section 552.130 of the Government Code provides that information relating to a motor vehicle operator's license, driver's license, motor vehicle title, or registration issued by a Texas agency is excepted from public release. Gov't Code § 552.130(a)(1), (2). Accordingly, we agree that the city must withhold most of the information you have marked pursuant to section 552.130. We have marked some additional information that must be withheld under section 552.130. However, we note that the vehicle year you have marked does not constitute motor vehicle record information for purposes of section 552.130, and may not be withheld on this basis. Therefore, except for the information we have marked for release, the city must withhold the information you have marked, and the additional information we have marked, under section 552.130 of the Government Code. Section 552.136(b) of the Government Code states that "[n]otwithstanding any other provision of [the Act], a credit card, debit card, charge card, or access device number that is collected, assembled, or maintained by or for a governmental body is confidential." Id. § 552.136(b); see id. § 552.136(a) (defining "access device"). This office has determined insurance policy numbers are "access device" numbers for purposes of section 552.136. Thus, the city must withhold the insurance policy number you have marked under section 552.136 of the Government Code. (1) In summary, the city must withhold the information you have marked under section 552.101 of the Government Code in conjunction with section 772.318 of the Health and Safety Code, to the extent that this information is the 9-1-1 caller's originating telephone number and address furnished by a 9-1-1 service provider. Except for the information we have marked for release, the city must withhold the information you have marked, and the additional information we have marked, under section 552.130 of the Government Code. The city must withhold the insurance policy number you have marked under section 552.136 of the Government Code. The remaining information must be released to the requestor. This letter ruling is limited to the particular information at issue in this request and limited to the facts as presented to us; therefore, this ruling must not be relied upon as a previous determination regarding any other information or any other circumstances. This ruling triggers important deadlines regarding the rights and responsibilities of the governmental body and of the requestor.
