Dear Mr. Scott:

You ask whether certain information is subject to required public disclosure under the Public Information Act (the "Act"), chapter 552 of the Government Code. Your request was assigned ID# 336199.

The City of Conroe (the "city") received a request for information pertaining to the requestor and a named individual during a specified time period, including information pertaining to specified incidents. You state you have released basic information to the requestor. You also state you do not have information responsive to a portion of the request. (1)

You claim that the submitted information is excepted from disclosure under sections 552.108 and 552.130 of the Government Code. We have considered the exceptions you claim and reviewed the submitted information.

You raise section 552.108(a)(2) of the Government Code for the submitted information. This section excepts from disclosure information concerning a criminal investigation that concluded in a result other than conviction or deferred adjudication. Gov't Code § 552.108(a)(2). A governmental body claiming section 552.108(a)(2) must demonstrate that the requested information relates to a criminal investigation that has concluded in a final result other than a conviction or deferred adjudication. You state that the submitted information pertains to concluded investigations that did not result in conviction or deferred adjudication. Based on your representation and our review, we agree that the city may withhold the submitted information under section 552.108(a)(2) of the Government Code. (2)

Opportunities Dev. Corp. v. Bustamante, 562 S.W.2d 266, 267-68 (Tex. Civ. App.--San Antonio 1978, writ dism'd); Open Records Decision Nos. 605 at 2 (1992), 452 at 3 (1986), 362 at 2 (1983).

2. As our ruling is dispositive, we need not address your remaining argument against disclosure.
