Dear Mr. Bounds:

You ask whether certain information is subject to required public disclosure under chapter 552 of the Government Code, the Public Information Act (the "Act"). Your request was assigned ID# 336936.

The City of Corpus Christi (the "city") received a request for the dispatch recordings on December 13, 2008 from 1:00 to 4:00 a.m. and information regarding an incident involving Rodney Emile Eulenfeld occurring on the same day. The city released most of the information and asserts portions are excepted from disclosure under sections 552.101 and 552.130 of the Government Code. We have considered the city's claimed exceptions to disclosure and have reviewed the submitted information.

Section 552.130 excepts from public disclosure information relating to a Texas driver's license or motor vehicle title or registration. Gov't Code § 552.130. We agree the submitted document and disc contain a Texas driver's license number and other Texas motor vehicle record information excepted from disclosure under section 552.130. The city states it does not possess the technological capability to redact the information from the disc. Thus, we agree the city must withhold the entire disc and the Texas driver's license number it marked in the document under section 552.130. Because section 552.130 is dispositive, we do not address the city's section 552.101 assertion.

This letter ruling is limited to the particular information at issue in this request and limited to the facts as presented to us; therefore, this ruling must not be relied upon as a previous determination regarding any other information or any other circumstances.
