Dear Mr. Allen:

You have asked whether certain information is subject to required public disclosure under the Texas Public Information Act, chapter 552 of the Government Code. Your request was assigned ID# 126311.

The Richardson Police Department received a request for the same information that was the subject of a prior ruling from this office, Open Records Letter No. 99-1297 (1999). In that ruling, we agreed that you could withhold all of the information at issue except for the front page offense and arrest report information under section 552.108(a)(1) of the Government Code. Open Records Letter No. 99-1297 (1999). Assuming that the investigation of the offense is still ongoing or that the prosecution of the offense is pending, we agree that these records may still be withheld from disclosure for the same reasons and under the circumstances outlined in Open Records Letter No. 99-1297 (1999). We have enclosed a copy of that ruling for your convenience.
