OR99-1123 Dear Mr. Steiner: You ask whether certain information is subject to required public disclosure under the Public Information Act, chapter 552 of the Government Code. Your request was assigned ID# 123823 The City of Austin (the "city") received a request for the appraisals of three tracts of land recently acquired by the city.(1) You have supplied the responsive information for our review. In Open Records Letter No. 99-0036 (1999) our office ruled that information responsive to a request for "appraisals of all parcels of land the Austin City Council has voted to purchase under Proposition 2," could be withheld from public disclosure pursuant to section 552.105 of the Government Code. The city contends that the information responsive to the current request is the same as that at issue in Open Records Letter No. 99-0036. Based on a review of the submitted information and your representation that the subject property was acquired by the city in its ongoing "Proposition 2" program of land acquisition, we conclude that this information is a subset of the information held by our office in Open Records Letter No. 99-0036 to be properly withheld from public disclosure.
